Using U.S. Patent Documents in Egypt

Patent rights are territorial: a U.S. patent gives no protection in Egypt on its own. Yet U.S. patent documents are regularly needed there, to claim priority for an Egyptian application, to record who owns or licenses an invention, to support a technology transfer agreement, or to prove rights in a dispute. In each case the Egyptian side will want an official copy from the United States Patent and Trademark Office (USPTO) that has been legalized for use in Egypt.

The Egyptian Patent Office

Patents in Egypt are handled by the Egyptian Patent Office, which sits within the Academy of Scientific Research and Technology. Egypt is a member of the Paris Convention and the Patent Cooperation Treaty, so a U.S. applicant can enter Egypt either directly within the Paris priority year or through the PCT national phase. Egyptian filings are made through a local patent agent and must be submitted in Arabic, so the agent will usually arrange translation of the specification and of supporting documents.

Which U.S. document you need

The right USPTO document depends on what you are doing in Egypt. A certified copy of the U.S. application serves as the priority document for a direct Paris Convention filing. A certified copy of the issued patent is used to show an existing U.S. grant, for example in licensing negotiations or court proceedings. For ownership changes, a certified copy of the recorded assignment from the USPTO assignment records proves the transfer. Ask your Egyptian agent which one is expected, because a plain printout from the USPTO website is not an official copy and will not be legalized.

Licensing, transfer and recordal

Egyptian law places weight on technology transfer contracts and on recording changes of ownership and licenses with the patent office. When a U.S. company licenses or assigns an Egyptian patent, the agreement itself is typically signed by company officers before a notary and legalized as a private document, while the USPTO records showing title in the U.S. family follow the federal route described below. Keeping the names of the owner and inventors identical across all these documents avoids queries at the Egyptian office.

Federal route to the Embassy of Egypt

USPTO certified copies are federal records, so they skip the notary and Secretary of State. The Arab American Chamber of Commerce presents the certified copy to the U.S. Department of State for authentication and then to the Embassy of Egypt for legalization. Egypt does not accept apostilles.
